St. Martin jury belives man knew wife was alive when dumping her in canal; returns first-degree conviction

ST. MARTINVILLE -- A jury on Wednesday convicted Dewayne Joseph, 34, of first-degree murder, punishable by death, in the drowning of his wife in 2009.

Prosecutor Chester Cedars convinced the 12-person panel that Joseph, of Houma, meant to kill Delores Robertson Joseph, 31, of Patterson when he chained her to a dolly and dumped into a canal in lower St. Martin Parish.

Craig Colwart, Joseph's attorney, argued that Joseph thought he had already killed her in a bedroom squabble and was merely disposing of the body.

Had the jury gone along with the defense, Joseph could have gotten off with second-degree murder, meaning a life stretch in prison, or even manslaughter.
