MANGHAM TOWN COUNCIL MEETING
NOVEMBER 11, 2008
The Mangham Town Council met in regular session at the Mangham Town Hall on Tuesday, November 11, 2008, 6:00pm. Mayor Robert Neal Harwell presided and Alderpersons Zona McKay, Perry Fleming and John Natt were present. Ida Gilley and Billy Bruce were absent.
The meeting was opened with an invocation by Zona McKay.
On a motion by McKay, seconded by Fleming, the minutes from the last meeting were approved.
The Mangham Police Department reported 65 arrests for October 2008.
The Mangham Town Council have selected retired school teachers who taught at Alto, Archibald, and Mangham schools before 1970 to serve as Grand Marshals for the 2008 Mangham Christmas Parade.
On a motion by Natt, seconded by Fleming, the financial report was approved.
On a motion by Fleming, seconded by Natt, the bills are to be paid.
On a motion by McKay, seconded by Fleming, the meeting was adjourned.

A petition has been filed with the Town of Mangham to enlarge part of the western boundary of the Town of Mangham, to encompass the properties located along the southern edge of Louisiana Highway 132, west of West Street, to the western boundary of residential property owned by William Lee Bruce Jr. An ordinance enlarging the town limits shall be proposed accordingly and voted on at regularly scheduled town council meeting held in December of 2008, unless a hearing is requested pursuant to La. Revised Statue 33:172(B).

ORDINANCE #1199
RICHLAND PARISH UNNECESSARY NOISE
(a) Unnecessary noise prohibited. It shall be unlawful for any person to make a continue or cause to made continued any loud, unnecessary or unusual noise or any noise which either annoys, disturbs, injures or endangers the comfort, repose, health peace or safety of others, within parish limits.
(b) Nonexclusive enumeration of unnecessary noise. The following acts among others, are declared to be loud, disturbing and unnecessary noises and noises in violation of this section, but this enumeration shall not be deemed to be exclusive, namely:
(1) Horns or signal devices. The sounding of any horn or signal device on any automobile, motorcycle, bus, streetcar or other vehicle while not in motion except as a danger signal if another vehicle is approaching apparently out of control, or if in motion only as a danger signal after or as brakes are being applied and deceleration of the vehicle is intended; the creation by means of any such signal device of any noise for any unreasonable period of time.
(2) Radio, phonograph or any musical instrument. The playing of any radio, phonograph or any musical instrument in such a manner or with such volume, particularly between the hours of 11:00 p.m. and 7:00 a.m., as to annoy or disturb the quiet, comfort or repose of persons in any office, hospital, or in any dwelling, hotel or other type of residence, or of any persons in the vicinity.
(3) Yelling, shouting, etc. Yelling, shouting, hooting, whistling or singing on the public streets, particularly between the hours of 11:00 p.m. and 7:00 a.m., or at any time or place so as to annoy or disturb the quiet, comfort, repose of persons in any hospital, dwelling, hotel or other type of residence, or of any persons in the vicinity.
(4) Animal, birds, etc. The keeping of any animal, bird or fowl which by causing frequent or long-continued noise shall disturb the comfort or repose of any person in the vicinity.
(5) Defect in vehicle or load. The use of any automobile, motorcycle, streetcar or vehicle so out of repair or loaded in such manner as to create loud and unnecessary grating, grinding, rattling or other noise.
(6) Steam whistles. The blowing of any steam whistle attached to any stationary boiler except to give notice of the time to begin or stop work, or as a warning of fire or danger or upon the request of proper authorities.
(7) Exhausts. The discharge into the open air of the exhaust of any steam engine, stationary internal-combustion engine, motor vehicle or motorboat engine except through a muffler or other device which will effectively prevent loud or explosive noises therefrom.
(8) Construction and repairing of buildings. The erection (including excavating), demolition, alteration or repair of any building in any residential district or section, the excavation of streets or highways in any residential district or section other than between the hours of 7:00 a.m. and 6:00 p.m. on week days, except in case of urgent necessity, in the interest of public health and safety, and then only with a permit from Richland Parish Sheriff, which permit may be granted for a period not to exceed 30 days while the emergency continues. If the sheriff should determine that the public health and safety will not be impaired by the erection, demolition, alteration or repair of any building or the excavation of streets and highways between the hours of 6:00 p.m. and 7:00 a.m., and if he shall further determine that loss or inconvenience would result to any party in interest, he may grant permission for such work to be done within the hour of 6:00 p.m. and 7:00 a.m. upon application being made at the time the permit for the work is awarded or during the progress of the work.
(9) Schools, courts, churches, hospital. The creation of any excessive noise on any street adjacent to any schools, institution of learning, church or court while the same are in use of adjacent to any hospital, which unreasonably interferes with the working of such institution or which disturbs or unduly annoys patients in a hospital.
(10) Loading, unloading. The creation of a loud and excessive noise in connection with loading or unloading any vehicle or the opening and destruction of bales, boxes, crates and containers.
(11) Drums, loudspeakers. The use of any drum, loudspeaker or other instrument or device for the purpose of attracting attention by creation of noise to any performance, show or sale or display of merchandise.
(12) Loudspeakers on trucks. The use of mechanical loudspeakers or amplifiers on truck or other moving or standing vehicles for advertising or other purposes.
(13) Loudspeakers for advertising. The use of operation, or the causing to be used or operated, in front of or outside of any building, place or premises, or through any window, doorway or opening of such building abutting upon the public street, or upon any public street any device or apparatus for tapping windows, or for amplifying sound form any radio or phonograph, or any sound-reproducing device.
(14) Hawkers, peddlers and vendor. The shouting or crying of peddlers, hawkers and vendors which disturbs the peace and quiet of the neighborhood.
(15) Stereo, audio devices, etc.
a. The use of any stereo, audio device, or noise-producing instrument in a manner as to annoy or disturb the quiet and comfort of persons in any residence, business, hospital, hotel or other building, or of any persons in the vicinity is unlawful.
b. The operation of any stereo, audio device, or noise-producing instrument shall be illegal when:
1. The stereo, audio device, or noise-producing instrument is located in any motor vehicle on a public street, highway, public space, or within the motor vehicular area of any public or private parking lot or park; and
2. The sound created by the stereo, audio device, or noise-producing instrument is audible at a distance of 30 feet from the stereo, audio device, or noise-producing instrument that is creating the sound.
c. Possession by a person of any stereo, audio device, or noise-producing instrument shall be prima facia evidence establishing that such person operates the stereo, audio device, or noise-producing instrument.
d. A parish police officer may issue a citation for any violation under this article. The officer may arrest violators under this section when:
1. The alleged violator refuses to provide his name and address and documentation reasonably establishing the same.
2. The alleged violator refuses to cease the action violating this section after receiving a citation.
e. Violators of this section of the Code of Ordinance shall be subject to a civil penalty in the amount of $500.00 for each offense.
(f) Exceptions. None of the terms or prohibitions hereof shall apply to or be enforced against:
(1) Any publicly owned vehicle while engaged upon necessary public business.
(2) Excavations or repairs of bridges, streets, or highways by or on behalf of any public agency during the night, when the public welfare and convenience renders it impossible to perform such work during the day.
(3) The reasonable use of amplifiers or loudspeakers in the course of public addresses which are noncommercial in character, and for which a permit is first obtained from the Sheriff.

The Board of Commissioners of the Tensas Basin Levee District met for its regular meeting Tuesday, November 11, 2008 at 9:30 A. M. in its office located at 505 District Drive Monroe, Louisiana.
Mr. Harris Brown, President, called the meeting to order and requested the Secretary call roll with the following present and answering: Harris Brown, President, Charles Venable, Vice President, and James Mayo, Ouachita Parish; Robert Neal Harwell, Richland Parish; Reggie Peters, Franklin Parish and Venoy Kinnaird, Morehouse Parish; Drew Keahey, Caldwell Parish and Harlon Nobles, LaSalle Parish. Absent: Rodney Hutchins, Catahoula Parish; Ramona N. Haire, Richland Parish and Shelton Ruffin, West Carroll Parish.
Others in attendance were: Mr. John Stringer, Executive Director, Tensas Basin Levee District; Mr. Theo J. Coenen, III, Attorney, Tensas Basin Levee District; Ms. Sharon Anders, Rayville, La.; Mr. W. T. Riles, Maintenance Supervisor, Tensas Basin Levee District and Mr. Johnny Trisler, Maintenance Superintendent, Tensas Basin Levee District.

WHEREAS, the Board of Commissioners of the Tensas Basin Levee District advertised for surface leasing for hunting rights for a period of five years following:

N of NW , Section 31, Township 13 North, Range 9 East, Containing 80 acres, more or less.
WHEREAS, the time having arrived for the opening of bids, the following bids were received, opened and read aloud:

SUMMARY NO. ORDINANCE NO. 1200
An ordinance relative to the creation of the Richland Parish Children and Youth Planning Board, in accordance with La. R.S. 46:1941.1 et seq., as amended by Act 555 of 2004; establishing the composition of the board, providing for its functions and duties, and to provide for related matters.
WHEREAS, La. R.S. 46:1941.1 et seq., as amended by Act 555 of 2004, mandates that the governing authority of each parish establish a children and youth planning board in each judicial district; and
WHEREAS, La. R.S. 46:1941.1 et seq., as amended by Act 555 of 2004, further provides that the parish’s sole responsibility is the establishment and appointment of such board and that nothing in said statute mandates that the parish is responsible for funding the operational expenses of such board; now, therefore,
THE RICHLAND PARISH POLICE JURY HEREBY ORDAINS, acting as the governing authority of the Parish of Richland, State of Louisiana, and in accordance with the mandate of La, R.S. 46:1941.1 et seq., as amended by Act 555 of 2004, that:
